POLICY

The appropriate Service Director or delegate approves individual work schedules.  The Agency reserves the right to alter hours of work subject to changing program and staffing requirements.

PROCEDURE

All hours worked beyond the normal hours for the position must be approved and documented in writing and designated as overtime or flextime by the staff and his/her Manager or delegate prior to working those hours. 

Overtime is time worked at the request of the Agency to meet the demands of the program. Following are examples of overtime:

  1. In a residence, the next shift relief person does not arrive and the staff is asked to stay beyond the scheduled shift,
  2. A situation arises at the end of the day that requires the Supervisor to request the staff to stay beyond the end of his/her shift in order to resolve it,
  3. A part time staff is not available and a full time staff is asked to work beyond his/her normal work hours.

Approved overtime hours will be paid to the staff at the normal hourly rate in accordance with Employment Standards Act, 2000.  Approved overtime hours that take a staff beyond 44 hours in a workweek will be paid at one and one-half times the normal hourly rate.

The Employment Standards Act, 2000 states that overtime does not apply to Managers and Supervisors if the only tasks they perform are managerial or supervisory.  Overtime will also not apply to positions that perform non-managerial or non-supervisory tasks only on an irregular or exceptional basis.
 
Flextime is when, at his/her discretion and with the approval of his/her Manager or delegate, the staff stays beyond his/her regular workday to complete work and arranges with his/her Supervisor for time off to compensate at a future date.  An example is when a staff needs to leave early one day and stays in the evening to make up the hours.

When a staff is scheduled to work an irregular schedule to accommodate the needs of the program, this is not considered flextime.  It does not require prior approval but is based upon the approved staff schedule.  The total hours scheduled do not exceed the normal working hours for the position.  An example is a staff who is scheduled to facilitate a group in the evening and is compensated with time off during his/her regular workweek.

In order to compensate for flex hours worked, lieu time equivalent to the hours worked must be taken within ninety days.  Suitable lieu time must be approved by the staff’s Manager or delegate.

No overtime pay or lieu time will be given if the above procedures are not followed (see Overtime and Flextime Sheets in Appendix 19).
